Hellerstein on Friday reaffirmed that Trump was too late and that the verdict withstands presidential immunity anyway.

“The grounds for a second removal cited by Defendant, Donald J. Trump, are neither new nor legally sufficient. He has failed to show good cause and diligence,” the judge wrote.

“They do not; paying hush money to an adult film star or engaging in a cover-up of an embarrassment are not subsumed in presidential immunity,” Hellerstein pushed back in his ruling.

    This is an ENORMOUSLY important ruling. When everybody was getting all excited about SCOTUS giving Trump full immunity, there were reasons to remain optimistic.

    There had never been guide rails on the presidency before, and for the first time, guide rails were installed, when SCOTUS said he had immunity for OFFICIAL acts. That’s a really important qualifier, especially considering there were NO rules before.

    So what are “Official” acts? It seems obvious that the ONLY Official acts would be the presidential responsibilities as outlined in the Constitution. By using the qualifier “Official,” they are drawing a clear line between official and unofficial duties. He has immunity for Official things, but not for anything outside of his “Official” duties. This judge has stated specifically that paying hush money, and engaging in a cover-up, are not “subsumed” (included/ covered) in Presidential Immunity. He is making a clear distinction between Official and Unofficial acts, with unofficial acts, such as crimes, not covered.

    This is the first time that a judge has said that the president doesn’t have full immunity for EVERYTHING, especially criminal behavior. The importance of this cannot be overstated. This means he doesn’t have immunity for ANY of his criminal activities.

    This corrupt, treasonous pedophile is criming all over the place thinking he is protected by immunity, and his lawyers are equally stupid, so he just keeps digging a deeper hole for himself, and that’s where he will ultimately end up.

      When does he get arrested for stoking an insurrection while plotting a coup? Same thing for him laying plans right now for fucking with the way states conduct their elections?

      I cannot wait for anyone who worked for him to start getting consequences, by the way. So many dumbfucks thinking they are above the law: Bondi, Blanche, Stephen Miller, and so on.

        When he stole the election in 2024, he was fighting the justice system with two major cases - The Jan 6 Insurrection, and the Stolen Documents Case. Those cases didn’t go away, they were just suspended. When he’s out, if Dems are in power, they could revive those cases, and I will be screaming for them to be re-opened on Inauguration Day.

        And there are a LOT of others who will go to prison, and there may even be some executions for those whose irresponsible behavior led to the deaths of thousands, such as Musk, Hegseth, RFK, Jr., and Trump, of course.

      Agreed and great point. One thing that has always been odd to me is that while he can cry it might have been official — he wasn’t president when this happened, and I’ve never seen this issue raised or reported.
